Terms of Service

1) Acceptance of the Terms

These Terms govern the use of CVRaptor, an online service available at https://cvraptor.com that provides AI-assisted CV and Job Description analysis/optimization tools. By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms.

2) Eligibility, Account, and Security

• Minimum age: use is prohibited for users under 16.
• Account: you are responsible for the accuracy of the data you provide, for keeping credentials confidential, and for all activity under your account.
• Security: CVRaptor may suspend or terminate the account in case of unusual or suspicious activity or violations of these Terms.

3) Services Provided (AI & ATS)

CVRaptor offers ATS analysis, suggestions and rewrites (e.g., CV, cover letter), CV–JD comparison, and recruiter tools. Results are generated by AI models and do not constitute professional advice and may contain errors or inaccuracies. You remain solely responsible for any final content you use. The Service does not guarantee hiring outcomes.

4) Plans, Pricing, Renewal, and Cancellation

• Plans: Free, Pro, Business, Business+ (where available). Limits and features are shown on the Site and may change.
• Billing: paid subscriptions renew monthly. You can manage or cancel anytime via the Customer Portal (Stripe) in one click.
• Effect of cancellation: cancellation stops future renewals; access stays active until the end of the current paid period. No refunds or credits for partial periods, pro-rata upgrades/downgrades, or unused time, except where mandatory law provides otherwise.
• Price change: CVRaptor may update prices/features; changes apply from the next cycle or as communicated.
• Taxes & invoices: prices may be VAT-exclusive/inclusive depending on country. Invoices/receipts are emailed automatically and available in the Customer Portal.
• Payment failures: we may retry charges, limit access, and/or suspend the account until payment is settled.

5) Limits, Fair Use, and Abuse

• Limits: each plan has thresholds (e.g., monthly analyses). Limits typically reset on the 1st of the month (Europe/Rome timezone), unless stated otherwise.
• Abuse: prohibited activities include evasive multi-accounts, illegitimate sharing, limit circumvention, scraping, attacks, or reverse engineering.
• Measures: CVRaptor may apply rate limits, suspension, or account closure.

6) Acceptable Use (AUP)

You must not use the Service to: (i) violate laws or third-party rights; (ii) upload unlawful content or content you are not entitled to use; (iii) generate/distribute SPAM or malware; (iv) conduct unauthorized security tests; (v) engage in activities that compromise the availability or integrity of the Service.

7) User Content and Licenses

• Ownership: you retain rights to content you upload (CVs, JDs, etc.).
• License for service delivery: you grant CVRaptor a non-exclusive, worldwide, limited-term license necessary to deliver the features (including processing by technical vendors and AI models, in line with the Privacy Policy).
• Responsibility: you warrant you have the rights to use and upload such content.

8) Service Intellectual Property

The software, trademarks, logos, interface, and service content (excluding user content) are owned by CVRaptor or its licensors and are protected by applicable laws. Unauthorized reproduction, modification, decompilation, or distribution is prohibited.

9) AI Disclaimer and No Professional Advice

AI-generated content is provided “as is” for informational/editorial purposes.CVRaptor does not provide professional advice (e.g., legal, tax, HR) and does not guarantee results are error-free or fit for specific purposes. You must always review and, if needed, edit the texts before using them.

10) Availability, Maintenance, and Changes

• Availability: CVRaptor uses reasonable efforts to keep the Service available but does not warrant continuous or error-free availability.
• Maintenance: we may temporarily suspend or limit access for technical work.
• Changes: we may update or remove features; you retain the right to cancel your subscription.

11) Exclusions and Limitations of Liability

To the maximum extent permitted by law: (i) the Service is provided “as is” and “as available”; (ii) CVRaptor is not liable for indirect, consequential, lost profits, loss of opportunity, or data loss; (iii) CVRaptor’s total liability to you, for any claim, is limited to the amount you paid to CVRaptor during the 12 months preceding the event giving rise to the liability. Nothing excludes or limits liability that cannot be excluded by law.

12) Indemnification

You agree to indemnify and hold CVRaptor harmless from claims, liabilities, damages, or costs (including reasonable legal fees) arising from unlawful use of the Service, breaches of these Terms, or third-party rights.

13) No-Refund Policy and Right of Withdrawal (EU Consumers)

CVRaptor provides digital services delivered online with immediate commencement of performance. For clarity:

• No-Refund: unless otherwise mandated by law, amounts already paid are non-refundable. No refunds or credits for unused time, partial periods, pro-rata upgrades/downgrades, data entry errors, or lack of use.
• Withdrawal (EU Consumers): for digital content/services delivered with immediate performance and with your explicit consent to start during the withdrawal period and acknowledgment of the loss of the right of withdrawal, such right may be excluded under applicable law. At checkout, we request such consent via a specific checkbox/ warning.
• How to cancel: you can cancel future renewals anytime from the Customer Portal. Cancellation takes effect from the next billing cycle and does not entitle you to refunds for the current period.
• Legal warranties: mandatory consumer remedies for lack of conformity of digital content/services remain unaffected. By accessing the Service immediately after payment, you provide express consent to immediate performance and acknowledge waiving the right of withdrawal for distance contracts, pursuant to Art. 59(o) of the Italian Consumer Code.

14) Chargebacks and Disputes

• Before disputing: for issues with charges or malfunctions, please contact support first at cvraptor@proton.me for a quick review.
• Baseless disputes: CVRaptor may provide usage evidence (access logs, analysis logs, invoices) to the payment provider and charge any direct costs caused by frivolous chargebacks, to the extent permitted by law; CVRaptor may also suspend access until the dispute is resolved.

15) Suspension and Termination

CVRaptor may suspend or terminate the account for violations of the Terms or risks to security/operations. You can close your account and/or cancel your subscription anytime from the Customer Portal.

16) Governing Law and Jurisdiction

These Terms are governed by Italian law. For disputes, the exclusive forum is the court where CVRaptor is based (—), unless mandatory consumer protection rules provide otherwise (in which case the consumer’s forum applies).

17) Miscellaneous

• Entire agreement: these Terms constitute the entire agreement between the parties and supersede prior understandings on the same subject.
• Severability: if any clause is invalid, the remaining provisions remain effective.
• Force majeure: neither party is liable for delays/failures due to force majeure (e.g., network outages, governmental actions).
• Assignment: you may not assign rights/obligations without CVRaptor ’s written consent. CVRaptor may assign the agreement as part of corporate reorganizations.
• Notices: via email/in-app notices and, where necessary, to the email address associated with the account.

18) Changes to the Terms

CVRaptor may update the Terms. Changes will be posted on this page and become effective upon posting. For material changes, we may send a dedicated notice. Continued use of the Service constitutes acceptance of the updated Terms.
